Phoenix Voyages is a TICO-licensed host travel agency (Ontario Registration No. 50026668) operating in Ontario, Canada. We provide infrastructure, technology, compliance, and support services to Independent Travel Advisors (ITAs), including:
- Brand and regulatory coverage under TICO (Travel Industry Council of Ontario)
- Access to booking platforms, CRM systems, and back-office technology
- Supplier relationships with airlines, hotels, cruise lines, and tour operators
- Marketing, training, and operational support
We also operate internal applications and integrations (such as PhxClaudeMCP) to manage our business operations, including accounting, client relationship management, and financial data processing through authorized third-party platforms.
3. User Obligations
As a user of our services, you agree to:
- Provide accurate, current, and complete information when requested
- Use our services only for lawful purposes and in compliance with all applicable laws and regulations
- Not attempt to gain unauthorized access to our systems, accounts, or data
- Not interfere with or disrupt the security, integrity, or performance of our services
- Not transmit any malicious code, spam, or harmful content through our platforms
- Maintain the confidentiality of any account credentials provided to you
- Notify us immediately of any unauthorized use of your account or any security breach
4. Intellectual Property
All content on our website and within our applications—including text, graphics, logos, images, software, and documentation—is the property of Phoenix Voyages or its licensors and is protected under Canadian and international copyright, trademark, and intellectual property laws.
You may not:
- Copy, modify, distribute, or republish any content without our prior written consent
- Use our trademarks, trade names, or brand assets without authorization
- Reverse-engineer, decompile, or disassemble any software or application we provide
5. Limitation of Liability
To the fullest extent permitted by applicable law, Phoenix Voyages and its directors, officers, employees, agents, and affiliates shall not be liable for any:
- Direct, indirect, incidental, special, consequential, or punitive damages
- Loss of data, revenue, profits, or business opportunities
- Damages arising from the use or inability to use our services
- Errors, interruptions, or delays in our services or third-party integrations
Phoenix Voyages acts as an agent for third-party travel suppliers and technology providers. We are not responsible for their acts, omissions, or service failures. Our total liability for any claim shall not exceed the fees paid by you to Phoenix Voyages in the twelve (12) months preceding the claim.
6. Indemnification
You agree to indemnify, defend, and hold harmless Phoenix Voyages, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from your use of our services, violation of these Terms, or infringement of any third-party rights.
7. Privacy
Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, disclose, and protect your personal information in compliance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable Canadian privacy legislation.
We are committed to protecting the confidentiality and security of all personal and financial data processed through our systems and integrations.
8. Third-Party Services
Our operations rely on authorized third-party services and integrations, including but not limited to:
- Intuit QuickBooks Online — accounting and financial management
- Payment processors — secure payment handling and transaction processing
- Booking and reservation systems — travel supplier platforms and GDS systems
- CRM platforms — customer and advisor relationship management
- Cloud infrastructure providers — data hosting and application services
Your use of our services may involve the transmission of data to and from these third-party platforms. Each third-party service is governed by its own terms of service and privacy policy. Phoenix Voyages is not responsible for the practices, policies, or availability of third-party services.
We access third-party platforms (including QuickBooks Online) solely for legitimate business purposes such as invoicing, financial reporting, and account management. We do not sell, lease, or share your financial data with unauthorized parties.
9. Data Security
We implement appropriate technical and organizational measures to protect data processed through our systems, including:
- SSL/TLS encryption for data in transit
- Access controls and authentication for internal applications
- Regular security reviews and software updates
- Secure credential storage and management
10. Termination
We may suspend or terminate your access to our services at any time, with or without cause, and with or without notice. Upon termination, your right to use our services ceases immediately. 12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
13. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
